This website is operated by Consigners Closet Pty Ltd (“we”, “us”, “our”). By accessing or using our website, purchasing items, or consigning goods with us, you agree to be bound by these Terms & Conditions (“Terms”).
These Terms apply to all users of the site, including browsers, customers, and consignors.
1. General Use of the Website
By using this website, you agree not to engage in any unlawful activity, breach applicable laws, infringe intellectual property rights, or interfere with the operation or security of the site.
We reserve the right to refuse service to anyone at any time.
2. Pre-Loved & Consignment Goods
Consigners Closet operates as a consignment retailer, acting as an agent on behalf of item owners.
All items sold are pre-loved unless otherwise stated and may show signs of gentle wear consistent with prior use. Product descriptions and images are provided to assist purchasing decisions.
3. Pricing & Availability
All prices are subject to change without notice.
We reserve the right to:

refuse or cancel orders

correct pricing, listing, or typographical errors
If an order is cancelled or amended, we will notify you using the contact details provided at checkout.
4. GST & Tax
Items sold on consignment are sold by Consigners Closet as agent only.
Under Australian GST law:

GST is payable on our commission only

GST is not included in the sale price of consignment goods

GST cannot be claimed on purchases
Receipts may be provided for record-keeping purposes.
5. Shipping & Delivery
Shipping options, costs, and delivery timeframes are outlined on our Delivery page and form part of these Terms.
Dispatch timeframes are estimates only. We are not responsible for delays caused by postal services, public holidays, or events beyond our control.
6. Returns & Refunds
All sales are final.
Returns, refunds, or exchanges are only accepted where an item is deemed faulty under Australian Consumer Law. Change of mind, fit, or general wear consistent with pre-loved items are not considered faults.
Faults must be reported in accordance with our Returns & Refunds policy.
7. Consigning With Us
Consignment acceptance, pricing, timeframes, splits, authentication requirements, and payout terms are outlined on our Consign With Us and Consignment FAQs pages and form part of these Terms.
By consigning with us, you acknowledge and agree that:

Full consignment terms are provided and agreed to prior to intake.
8. Payouts
Once an item has sold, the consignor will receive an automated notification.
Payouts are processed weekly on Wednesdays via bank transfer once the consignor confirms they wish to receive payment. Requests received after Wednesday morning will be processed the following week.
9. Additional Consignment Terms
The following terms apply specifically to items accepted on consignment and form part of these Terms.
Acceptance & Discretion
All items are accepted at the sole discretion of Consigners Closet. We reserve the right to refuse, withdraw, or discontinue sale of any item that no longer meets our standards or is deemed unsuitable for sale at any time.
Pricing Adjustments
Pricing is set at intake and is final. To support sell-through, we may apply price adjustments during the consignment period at our discretion. Consignors will not be contacted for approval prior to price changes.
Placement & Sales Channels
Decisions regarding how and where items are sold — including in-store, online, or via promotional channels — are made at our discretion. We do not guarantee online listing, feature placement, or minimum exposure.
Withdrawal of Items
Once accepted on consignment, items may not be withdrawn prior to the end of the agreed consignment period without approval. Early withdrawal requests may be declined or subject to an administrative fee.
Unsold Items
If an item does not sell within the agreed consignment period, it must be collected or otherwise managed in accordance with the consignment agreement. Items not collected within the specified timeframe may be handled at our discretion, including donation or disposal.
Authentication
Authentication may be required for certain designer items. Where applicable, any authentication fees are the responsibility of the consignor and must be approved prior to proceeding. Items later found to be inauthentic will be withdrawn from sale and managed in accordance with our policies.
Condition on Return
Where unsold items are returned to the consignor, they will be returned in the condition held at the conclusion of the consignment period, subject to reasonable handling consistent with retail display.
Loss, Damage & Liability
All reasonable care is taken while items are on consignment. To the maximum extent permitted by law, Consigners Closet is not responsible for loss, theft, or damage to consigned items beyond what is required under Australian Consumer Law. Further detail is outlined in the consignment agreement provided prior to intake.
Consignment Agreement Priority
In the event of any inconsistency between these Terms & Conditions and a signed consignment agreement, the consignment agreement will prevail.
10. Third-Party Services & Links
We are not responsible for third-party websites, payment providers, or delivery services. Use of third-party services is at your own risk and subject to their terms.
11. Personal Information
Your personal information is handled in accordance with our Privacy Policy, which forms part of these Terms.
12. Errors & Omissions
We reserve the right to correct errors, inaccuracies, or omissions at any time without prior notice.
13. Prohibited Conduct
You must not misuse the website, upload malicious code, scrape content, submit false information, or engage in any activity that compromises site security or integrity.
14. Limitation of Liability
To the maximum extent permitted by law, Consigners Closet Pty Ltd is not liable for loss or damage arising from use of the website or purchase of goods, except where liability cannot be excluded under Australian Consumer Law.
15. Indemnity
You agree to indemnify and hold harmless Consigners Closet Pty Ltd from any claims arising from your breach of these Terms.
16. Governing Law
These Terms are governed by the laws of Western Australia, Australia.
